Defending Against A Claim

Business disputes typically follow a structured process that gives you multiple opportunities to resolve the matter before trial. The stages can include:

1. Demand Letter

You receive a formal demand letter from someone who claims you owe them damages. The demand letter describes what they claim you owe and the potential consequences if you don’t respond. You should immediately contact an attorney to review the matter and discuss your options.

2. Responding To A Demand Letter

Together with your lawyer, you will determine the best response strategy. This typically involves drafting a response that summarizes your position and explores compromise opportunities. Initiating settlement discussions at this stage can help you avoid costly litigation and strengthen your position if a lawsuit does follow.

3. Filing Of A Complaint

If you cannot reach a compromise, the other party may file a complaint that officially starts a lawsuit against you. You will receive a copy of this legal document that outlines their claims.

4. Answer

You must respond to the complaint by filing an answer within a specific time frame. Failing to respond on time puts you at risk of losing by default. The answer either admits or denies the allegations and presents your legal defenses and any counterclaims. In some cases, we may be able to get the lawsuit dismissed at this stage due to legal deficiencies in the complaint.

5. Discovery

You can gather evidence to support your position through the discovery process. Discovery may include requesting and reviewing relevant documents, as well as conducting depositions where witnesses answer questions under oath.

6. Summary Judgment

After discovery, you have another opportunity to end the dispute before trial through summary judgment. This process uses evidence gathered during discovery and requires technical legal documents that experienced attorneys must prepare.

7. Trial

If the dispute remains unresolved, you will proceed to trial. In civil trials, the party making the claim must prove their case by a “preponderance of the evidence,” meaning it’s more likely than not that their claim is valid. You can win by preventing them from proving their case or by establishing a successful defense.

We can assist you at any stage of a business dispute. However, contacting us early in the process maximizes your chances of a favorable outcome.
